By accessing or using the website at cambridgeconcretecontractor.com(the "Site"), by requesting an estimate, or by engaging Cambridge Concrete("we," "us," or "our") to perform concrete services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Site or engage our services.
We reserve the right to update these Terms at any time. Changes take effect immediately upon posting to the Site. Continued use of the Site or our services after any update constitutes acceptance of the revised Terms.
Cambridge Concrete provides residential and commercial concrete services in Cambridge, Massachusetts and surrounding communities. Services include, but are not limited to, concrete driveways, patios, sidewalks, steps, floors, pool decks, retaining walls, slab foundations, foundation installation and raising, concrete footings, parking lots, decorative concrete, stamped concrete, and concrete cutting.
All services are subject to the terms of a written project agreement or contract executed between Cambridge Concrete and the customer before work begins. In the event of a conflict between a written project contract and these Terms, the written project contract governs.
Estimates provided by Cambridge Concrete, whether delivered in person, by phone, or in writing, are based on information available at the time of assessment and are valid for 30 days from the date of issue unless otherwise stated. An estimate is not a binding contract. A formal written contract must be signed by both parties before work begins.
Final pricing may differ from an estimate if conditions discovered during site preparation, excavation, or construction materially differ from what was observable at the time of the estimate. Any change that affects the project price by more than a minor amount will be presented to the customer as a written change order for approval before the additional work proceeds.
All prices are stated in U.S. dollars. Applicable taxes, permit fees, and disposal costs will be itemized in the written contract or change order.
Project start dates are scheduled upon execution of a written contract and receipt of any required deposit. Cambridge Concrete will make reasonable efforts to adhere to scheduled dates but is not liable for delays caused by weather, material delivery delays, permit processing timelines, site access issues, or other circumstances outside our reasonable control.
If you need to reschedule, please notify us as soon as possible. Cancellation of a signed contract after materials have been ordered or mobilization has occurred may result in forfeiture of the deposit and responsibility for reasonable costs incurred to that point. Specific cancellation terms will be stated in the written project contract.
Payment terms are as stated in the written project contract. A deposit is typically required before work begins, with the balance due upon project completion unless a different schedule is agreed in writing. Invoices not paid within the timeframe stated in the contract may accrue interest at a rate of 1.5% per month (18% per year), or the maximum rate permitted by applicable law, whichever is lower, from the date the payment was due.
Cambridge Concreteaccepts payment by check, bank transfer, or other methods as stated in the project contract. We reserve the right to place a mechanic's lien on the property for unpaid amounts as permitted under Massachusetts law.
Cambridge Concrete will obtain applicable building permits required for permitted concrete work under Massachusetts law and Cambridge city ordinances. Permit fees are the responsibility of the customer and will be itemized in the project contract. The customer is responsible for ensuring that the project site is accessible to inspectors and for providing any property information required for permit applications.
All work will be performed in accordance with the Massachusetts State Building Code (780 CMR) and applicable local ordinances. Cambridge Concrete is not responsible for pre-existing code violations or conditions on the property that are unrelated to the contracted scope of work.
Cambridge Concrete warrants that all work will be performed in a workmanlike manner using materials that meet or exceed the specifications stated in the written project contract. Any warranty specific to a project will be stated in that contract.
Concrete is a natural material subject to minor cracking, color variation, and surface texture variation that are inherent to the material and do not constitute defects. Warranty coverage does not extend to damage caused by customer misuse, unauthorized modifications, deicing salt application during the first winter after installation, tree root intrusion, ground settlement outside the project area, or events outside Cambridge Concrete's control.
Except for the limited workmanship warranty described above, the Site and any information on it are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Cambridge Concrete's total liability for any claim arising from the services or from use of the Site will not exceed the total amount paid by the customer for the specific project giving rise to the claim.
In no event will Cambridge Concrete be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or loss of data, even if Cambridge Concrete has been advised of the possibility of such damages.
If a dispute arises between you and Cambridge Concrete regarding services or these Terms, the parties agree to attempt to resolve it first through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue resolution through mediation before a mutually agreed mediator in Cambridge, Massachusetts, before initiating formal legal proceedings.
Nothing in this section limits either party's right to seek injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and any dispute arising from them or from the services provided byCambridge Concrete are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions. Any legal action not resolved through the dispute resolution process above will be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and both parties consent to personal jurisdiction in those courts.
All content on the Site, including text, images, logos, and graphics, is the property of Cambridge Concrete or its content suppliers and is protected by applicable copyright and trademark laws. You may access and use the Site for personal, non-commercial purposes related to evaluating or engaging our services. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.
We may revise these Terms at any time by posting a revised version to the Site with an updated effective date. Material changes will be noted at the top of this page. Your continued use of the Site or our services after revisions are posted constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
